Privacy Policy of «AqchaPay» Payment Service

This Privacy Policy governs the relationship between «AqchaPay» (hereinafter — the Service Operator or AqchaPay) and individuals who are Users of the AqchaPay payment service (hereinafter — «Service»), when Users perform operations using the Service.

The Policy applies to all information that the Service Operator may obtain about the User during the use of the Service. By using the AqchaPay Service, the User unconditionally accepts and agrees to this Policy and the personal information processing conditions stated herein. If the User disagrees with these conditions, they must refrain from using the AqchaPay Services.

1. Terms and Definitions

User — any legally capable individual, a bank card holder, intending to use the AqchaPay Service.

AqchaPay Service — a payment service enabling the User to make payments for goods and services online, manage bank cards, make money transfers via bank card, and perform other actions provided by the Service's functionality.

Personal Data — information relating to a specific individual or enabling their identification, provided by the User for the purpose of using the Service.

Personal Data Processing — collection, systematization, storage, modification, use, provision, distribution, anonymization, and destruction of personal data.

2. Information About Users Processed by AqchaPay

• 2.1. The type of information AqchaPay receives from Users is either personal or of a general nature.
• 2.2. Personal information. When registering, updating data, making payments, participating in promotions, or contacting support, the User provides information that AqchaPay stores and processes: payment credentials, phone number, bank card numbers, name, email, transaction history, registration data, and any other personal data necessary for using the Service.
• 2.3. General information. AqchaPay also receives general data that does not personally identify the User: type of action performed (click, hover, etc.); date and time; page URL; IP address; UserAgent; ClientID; screen resolution; search queries; geolocation; error reports; data about phone contacts; form submission events in the application.
• 2.4. The User agrees that AqchaPay may use statistical data and cookies, including transferring them to third parties for research and service provision. Users may manage cookies through browser settings. Blocking cookies may limit access to some Service components.

3. Principles and Conditions of Personal Data Processing

• 3.1. AqchaPay's personal data processing is carried out in strict compliance with the legislation of the Republic of Uzbekistan and in accordance with the Public Offer.
• 3.2. Only personal data that meets the processing purposes is processed. Excess collection is not permitted.
• 3.3. AqchaPay ensures the accuracy, sufficiency, and relevance of personal data, and takes measures to delete or correct incomplete or inaccurate data.
• 3.4. AqchaPay may delegate personal data processing to a third party with the data subject's consent, subject to confidentiality and data security obligations.
• 3.5. The User's personal information may be used for the following purposes:
  3.5.1. User identification;
  3.5.2. Improving the security of Service use;
  3.5.3. Communicating with the User, sending notifications, and processing requests;
  3.5.4. Conducting marketing activities and targeting advertising;
  3.5.5. Preventing actions contrary to legislation or agreement requirements;
  3.5.6. Improving Service quality and developing new services;
  3.5.7. Executing the Client's instructions for money transfers or refunds.

4. Processing and Transfer to Third Parties

• 4.1. AqchaPay ensures the confidentiality of User information.
• 4.2. AqchaPay stores User information in accordance with applicable legislation and internal regulatory documents.
• 4.3. Transfer of personal information to third parties is permitted in the following cases:
  4.3.1. The User has given consent;
  4.3.2. Transfer is necessary to execute the User's instruction;
  4.3.3. Transfer is required by the legislation of the Republic of Uzbekistan;
  4.3.4. To protect the rights and interests of AqchaPay or third parties in case of User violation of the Public Offer or applicable law;
  4.3.5. Processing complies with the legislation of the Republic of Uzbekistan in accordance with the Public Offer.

5. Personal Information Protection Measures

• 5.1. AqchaPay takes necessary organizational and technical measures to protect the User's personal information from unauthorized access, destruction, modification, blocking, copying, distribution, and other unlawful actions by third parties.
• 5.2. Personal data protection and processing is carried out in accordance with the Law of the Republic of Uzbekistan "On Personal Data" (ZRU-547, 02.07.2019) and other applicable regulatory acts.

6. Policy Changes

• 6.1. AqchaPay reserves the right to amend this Privacy Policy. The new version takes effect upon publication. The current version is always available on the Service website.
• 6.2. The legislation of the Republic of Uzbekistan governing personal data protection applies to this Policy.

7. Questions and Consent

• 7.1. Users may send any questions, complaints, or inquiries regarding this Policy to the contacts in Section 8.
• 7.2. AqchaPay reserves the right not to respond to questions unrelated to this Policy.
• 7.3. By using the Service, the User consents to the collection, processing, and cross-border transfer of personal data in accordance with applicable legislation.
